40 Trial Lawyer • Spring 2024 Dr. Tiffany Brandreth By Dr. Tiffany Brandreth Over the past three years, I’ve had the opportunity to gather a substantial amount of qualitative research by interviewing, speaking with and listening to hundreds of attorneys across the United States. This diverse group encompassed individuals ranging from five to 35 years of experience and spanning the spectrum from solo practices to large firms. This provided valuable insights into attorneys' perspectives and lived experiences as they navigate their careers. A palpable fatigue surrounds Diversity, Equity and Inclusion (DEI), consisting of irritation with its perceived overemphasis to frustration over its disinterest reminiscent of the pre-George Floyd era. It's apparent that the divide in society and in the nation are widening, perpetuating the angst between those with polarizing viewpoints. Yet, within this spectrum, a persistent quest for answers endures, with provocative, valid questions still being asked. Despite the industry’s long acquaintance with the terms D, E and I, a pervasive confusion exists about their distinctiveness and how they are interconnected. The aspiration where we coexist and collaborate without bias, remains elusive. Therefore, my aim is to remove the ambiguity and define with succinct clarity, the separate nature and interconnectivity of diversity, inclusion, and equity in this sequence. I will simplify the complexity of each term by distilling each concept down to its fundamental principle, its barrier and the gateway to its attainment. With each term, I propose specific steps for those seeking solutions to bridge the gap toward the ideal state of equality, justice and unity. By undertaking these actions, you will experience growth that generates a ripple effect, enhancing your existing relationships and cultivating the capacity to form more genuine, diverse connections beyond your current circle. Allow me to present my definition of inclusion, which will serve as the guiding framework for the remainder of this article. Typically, definitions remain incomplete and a factor in why we have lagged behind in making progress. My definition: The measurement of inclusion is the ability of individuals to authentically express themselves, thrive and excel without the necessity to conform in presence or demeanor to be recognized and regarded as intellectually and proficiently equivalent. This facilitates tangible access to opportunities and advancement directly associated with the individuals’ financial earnings and economic progress. Root of diversity The notion of diversity can be grasped through one straightforward question. Upon entering any environment, whether consciously or subconsciously, you instinctively wonder: Are there people who resemble me that naturally gravitate toward me, or vice versa, or is it evident I'm the only one or one of a few? This stands distinctly apart from social awkwardness or introversion. Its importance lies in the profound impact it carries, be it in a social setting or any professional landscape. An inherent favor arises when a majority of individuals effortlessly share similar characteristics such as race, age, sexual orientation or gender. Those who fit into the majority experience significantly greater trust, favor and advantages in these contexts from the beginning, in contrast to those who do not.
