SAFETY NOTICE Oregon ELD Implementation Strategy By Amy J. Ramsdell, Administrator, ODOT Motor Carrier Transportation Division O regon’s Motor Carrier Transportation Division held a meeting on January 11, 2018, to discuss Oregon’s annual adoption of the Federal Motor Carrier Safety Regulations. Discussion centered on the federal requirement that intrastate motor carriers use electronic log devices. Oregon adopted the federal regulations in two previous years and included the ELD mandate for both interstate and intrastate motor carriers. Those who attended expressed the following concerns: ` ` ELD vendors have not completed the program for intrastate exceptions to the federal hours of service rules. The result is that the ELD displays a violation when the driver still has hours available, causing confusion. ` ` Many companies indicated they were still waiting for devices to be installed. ` ` There are additional concerns and questions about the hours of service regulations and exceptions granted to intrastate operations. The meeting provided valuable insight into the struggles that our local intrastate companies are having with the implementation. There was strong support to make a request for additional time to work through these issues. MCTD staff considered all comments provided at the meeting, contacted vendors, and verified the various intrastate exemptions have not been fully programmed in some devices and that more time was needed. At the February 8, 2018, Motor Carrier Transportation Advisory Committee meeting, MCTD staff proposed a delayed implementation for qualified intrastate operations. The committee approved the proposal. MCTD staff will travel around the state to conduct additional meetings to answer questions motor carriers have related to hours of service and the ELD mandate. We will revisit the rules again in 2019 during our annual adoption of the Federal Motor Carrier Safety Regulations.
